In-Person Hearings

All hearings will be in-person unless the Court notifies the parties that the hearing will be conducted remotely through Google Meet or the Court grants a request to appear remotely in advance of the hearing.

Please connect to your hearing 5 minutes before it is scheduled to start and silence your microphone.

If you were not given prior permission to attend the hearing by video or phone, the Court may disconnect you.

Motions and Requests for Hearing

[Rule 1-007.1 Rule LR1-201]

Division IV requires all counsel and pro se parties to comply with Rule 1-007.1 NMRA and Rule LR1-201 NMRA regarding the submission of motions and exhibits.

According to Rule 1-007.1 NMRA and Rule LR1-201(F), at the expiration of all responsive times, the movant shall submit to the Court, either electronically or by hard copy the motion “package” which shall include copies of the following documents: 1) the motion, 2) any response, 3) any reply, 4) a notice of completion of briefing, 4) a request for hearing and 5) a blank notice of hearing (in Word format if submitted electronically). Copies of the package must also be served on all parties and the service must be indicated in the submission.

A hearing will not be scheduled on a motion until the expiration of all responsive times and the package is submitted to the Court.

The Court follows Rule LR1-201(H) for requests for expedited decisions or hearings.

Exhibits

Exhibits intended for use during a hearing or trial shall be delivered to Division IV either electronically or by hard copy (if pro se) if there are 20 pages or less; or by hard copy if there more than 20 pages. All exhibits shall be tabbed, labeled and three-hole punched. Binders are not required.

Copies of all exhibits must also be delivered to the opposing party. Exhibits shall be delivered at least 24 hours before a Domestic Violence Hearing and at least 48 hours before all other hearings or trials. Exhibits that are not delivered or exchanged as required may not be allowed by the Court.
